I have searched for some time for an answer to this, but haven't found an
answer. I apologize if you guys have answered this many times.

I understand that I need my own CD-ROM and license for any OS in order to
install it as a guest OS under virtualization software (Virtual PC or other).
Also, Microsoft encourages people to upgrade to Vista and use Virtual PC for
apps incompatible with the new OS.

However, what if those apps require Win98? Where is the average user
supposed to get a copy of Windows 98? As I understand it, Microsoft isn't
selling it, and I thought they didn't allow others to sell it anymore. Maybe
I misunderstand on that last point. I see some copies for sale on
miscellaneous web sites, but I'm not sure if it's legit to buy a copy from
them either.

Could someone with a clear picture of Microsoft legacy OS licensing please
fill me in? Thanks!!!

It's legit to buy a Win98 from a reseller or from an online action site like
eBay if this copy is not an OEM and has never been installed or has been
installed but later totally removed from the previous hardware. For OEM,
they cannot be resold if they have been installed, even if they have been
later removed from this particular hardware.

When you are a company and have one of the many possible volume licensing
agreements with Microsoft, you also have some rights to install or migrate a
copy of Win98 to a virtual environment.

Finally, there is also the possibility of using the downgrade right; ie. to
buy a copy of Vista or of WinXP and instead install copy of Win98.

Excerpt for the case of buying a legitimate, not-OEM version of Win98 from a
reseller, you must consult with your licensing specialist from MS to clarify
your situation.
